Please read the following terms and conditions carefully. These terms and conditions are a contract between you (“You” or “Customer”) with LookSee LLC d/b/a LookSeeBuy (“LookSeeBuy”). By visiting our website at LookSeeBuy.com, using our app, or ordering an inspection with LookSeeBuy, you are agreeing to be bound by these terms and conditions. The rights and obligations in your agreement with LookSeeBuy are personal to you, and not transferable to another party. You must be at least 18 years old to order an inspection with LookSeeBuy.

1. Description of LookSeeBuy Inspection LookSeeBuy is a web-based vehicle inspection service which seeks to allow customers to submit a vehicle inspection request to LookSeeBuy. If the application for a vehicle inspection request is accepted by LookSeeBuy, then LookSeeBuy will match a vehicle inspector (“Inspector”) with the customer to evaluate the overall condition of the designated vehicle, based on what our inspectors can subjectively observe (“Vehicle Inspection Report”). The Inspector can only report on what is seen or heard at the time of the inspection. LookSeeBuy’s service is a visual inspection of all reasonably accessible items only, and some problems may not be observable during the inspection. LookSeeBuy inspectors are not authorized to dismantle or disassemble the vehicle or any of its components. LookSeeBuy does not use hoists or tools. The inspector will not use a lift unless provided by the seller. The Inspector will attempt to test drive the vehicle, but if this is not feasible or if the seller does not permit, a test drive will not be conducted. Once the inspection is completed, you will receive a link to the inspector’s report, which may include package of photographs of the vehicle.
   Inspectors are independent contractors of LookSeeBuy who apply to become a part of LookSeeBuy network of vehicle inspectors. A majority of those whose applications are accepted are certified by the National Institute for Automotive Service Excellence (“ASE”), an independent non-profit organization dedicated to improving the quality of vehicle repair and service by testing and certifying automotive professionals. NOTWITHSTANDING THE FOREGOING STATEMENT, LOOKSEEBUY DOES NOT MAKE ANY REPRESENTATIONS OR WARRANTIES WHATSOEVER REGARING THE ACCREDITATION, REGISTRATION OR LICENSING OF ANY INSPECTOR.
2. LookSeeBuy Limitation of Services LookSeeBuy performs inspection services only. LookSeeBuy is not affiliated with the seller of the vehicle and does not offer an opinion on whether you should, or should not, purchase the vehicle. LookSeeBuy does not verify that the seller has the legal right to sell the vehicle. LookSeeBuy is not responsible for any representations made by the seller or any other party. LookSeeBuy does not verify the mileage on the odometer.
3. Inspection Is Not A Safety Inspection LookSeeBuy is not performing a safety inspection nor is the inspection, report or any other service by LookSeeBuy a warranty or an insurance policy for any vehicle. You acknowledge and agree that if you purchase any vehicle inspected by LookSeeBuy, you are fully responsible for all costs for repairs and maintenance on your vehicle, whether or not covered by any other insurance policy or warranty. You acknowledge and agree that the decision to purchase any vehicle remains your own responsibility and that you are responsible for determining whether a vehicle is under warranty or properly insured.
4. Vehicle Remains “As Is”  You acknowledge that the vehicle being inspected is a “used” vehicle and you agree that, even after inspection, you will be purchasing the vehicle in an “as is” condition, unless otherwise warranted by the seller. The vehicle’s condition may change between the time the inspection is conducted and the actual purchase of the vehicle, we recommend having the inspection completed as close in time to the purchase as possible. The LookSeeBuy report is not a substitute for any safety or emissions inspection that may be required by applicable state laws. LookSeeBuy does not inspect emissions. You acknowledge and agree that the LookSeeBuy inspection does not create any warranty for any vehicle you may purchase and that your right to recover for any defects in the vehicle, whether or not disclosed in the LookSeeBuy report, is limited to any warranty the seller may offer and specifically excludes LookSeeBuy.
5. Factors Affecting Inspections LookSeeBuy does not guarantee the external factors which may impact the inspections such as weather and light conditions, as well as the cleanliness of the vehicle, both inside and out, at the time of the inspection. Many external factors, beyond our control, can reduce the accuracy of the inspection, making things such as repainting and body work difficult to detect with the visual inspection offered. For the most accurate inspection report, the vehicle must be clean, dry and situated in well-lit location at the time of inspection. LookSeeBuy does not agree to take any steps or actions affecting the vehicle’s condition at the time of the inspection. LookSeeBuy encourages you make prior arrangements with the seller and make all necessary accommodations to ensure that the vehicle is as clean as possible and available in a suitable location for an inspection.
6. WARRANTY DISCLAIMER; LIMITATION OF LIABILITY 
   YOU ACKNOWLEDGE, BY YOUR USE OF THE SERVICES PROVIDED BY LOOKSEEBUY, THAT SUCH USE IS AT YOUR SOLE RISK.
   LOOKSEEBUY OFFERS SERVICES AS AN ONLINE VEHICLE CUSTOMER-INSPECTOR MATCHING AND REPORTING SERVICE. LOOKSEEBUY IS NOT A PARTY TO ANY TRANSACTION BETWEEN PROSPECTIVE OR ACTUAL BUYERS AND SELLERS OF VEHICLES, AND DOES NOT (i) GUARANTEE OR ENSURE THE AVAILABILITY, SAFETY OR CONDITION OF ANY VEHICLE OR ANY TRANSACTION BETWEEN YOU, OR PROSPECTIVE OR ACTUAL BUYERS AND SELLERS OF VEHICLES, INCLUDING CUSTOMERS AND SELLERS, (ii) COMPLETE ANY PURCHASE CONTRACT OR DOCUMENTATION ON BEHALF OF ANY PARTY TO THE TRANSACTION (iii) COLLECT OR PROCESS PAYMENT FOR, OR TRANSFER TITLE TO, ANY VEHICLE, OR (iv) STORE, SHIP OR DELIVER ANY VEHICLES. FURTHER, LOOKSEEBUY IS NOT RESPONSIBLE FOR ANY POTENTIAL VEHICLE SALE NOT CLOSING BY YOUR USE OF LOOKSEEBUY INCLUDING THE UNTIMELY ARRIVAL OF A LOOKSEEBUY INSPECTOR.
   LOOKSEEBUY IS NOT RESPONSIBLE FOR, AND DOES NOT VERIFY OR WARRANT, THE ACCURACY OR COMPLETENESS OF THE INFORMATION PROVIDED BY YOU, OR PROSPECTIVE OR ACTUAL BUYERS AND SELLERS OF VEHICLES.
   NEITHER LOOKSEEBUY, ITS AFFILIATES, NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS, OR LICENSORS MAKE ANY REPRESENTATIONS OR WARRANTIES, EXPRESS OR IMPLIED, TO ANY ACTUAL OR PROSPECTIVE BUYER OR SELLER OF ANY VEHICLE, AS TO i) THE EXISTENCE, OWNERSHIP, SAFETY OR CONDITION OF ANY VEHICLE, ii) THE ACCURACY OR COMPLETENESS OF ANY INFORMATION ABOUT A VEHICLE CONTAINED IN A LOOKSEEBUY VEHICLE REPORT, iii) MATCHING YOU AND THE VEHICLE WHICH IS THE SUBJECT OF THE RELATED LOOKSEEBUY VEHICLE REPORT, WITH A PARTICULAR INSPECTOR, OR iv) THE CREDENTIAL, CERTIFICATION OR QUALIFICATIONS OF ANY INSPECTOR. LOOKSEEBUY MAY, BUT HAS NO OBLIGATION TO, CORRECT ANY ERROR OR OMISSION ON THE SITE OR ANY LOOKSEEBUY VEHICLE REPORT. YOU MUST ADDRESS ALL CONCERNS, DISCREPANCIES AND/OR POTENTIAL ISSUES WITH A SELLER PRIOR TO THE SALE OF THE RELATED VEHICLE.
   ANY PROSPECTIVE SELLER OF A VEHICLE WHO PERMITS AN INSPECTOR TO INSPECT THE SELLER’S VEHICLE SHALL BE DEEMED TO HAVE WAIVED ANY AND ALL CLAIMS AGAINST LOOKSEEBUY FOR ANY CLAIMS OF MISREPRESENTATION OF VEHICLE FOR SALE, DAMAGE TO SUCH VEHICLE OR ANY OTHER INFORMATION CONTAINED IN A VEHICLE REPORT. LOOKSEEBUY IS NOT RESPONSIBILE FOR ANY POTENTIAL VEHICLE SALE NOT CLOSING AFTER INSPECTION OR OTHERWISE TERMINATING.
   YOU EXPRESSLY AGREE THAT YOUR USE OF THE SITE AND RELIANCE UPON THE INFORMATION CONTAINED IN A LOOKSEEBUY VEHICLE REPORT IS AT YOUR SOLE RISK. NEITHER LOOKSEEBUY, ITS AFFILIATES, NOR ANY OF THEIR RESPECTIVE EMPLOYEES, AGENTS, THIRD PARTY CONTENT PROVIDERS, OR LICENSORS WARRANT THAT THE SITE WILL BE UNINTERRUPTED OR ERROR FREE; NOR DO THEY MAKE ANY WARRANTY AS TO i) THE RESULTS THAT MAY BE OBTAINED FROM USE OF THE SITE, OR ii) THE ACCURACY OR RELIABILITY OF ANY CONTENT, INFORMATION, SERVICE, OR MATERIALS PROVIDED THROUGH THE SITE, INCLUDING ANY LOOKSEEBUY VEHICLE REPORT.
   THE SITE AND EACH LOOKSEEBUY VEHICLE REPORT IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPLIED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER APPLICABLE LAW. ADDITIONALLY, THERE ARE NO WARRANTIES RELATING TO ANY OF THE VEHICLES WHICH ARE THE SUBJECT OF LOOKSEEBUY VEHICLE REPORTS. THIS DISCLAIMER OF LIABILITY APPLIES TO ANY DAMAGES OR INJURY CAUSED BY ANY FAILURE OF PERFORMANCE, ERROR, OMISSION, INACCURACY, INTERRUPTION, DELETION, DEFECT, DELAY IN OPERATION OR TRANSMISSION, COMPUTER VIRUS, COMMUNICATION LINE FAILURE, THEFT OR DESTRUCTION OR UNAUTHORIZED ACCESS TO, ALTERATION OF, OR USE OF THE SITE OR ANY LOOKSEEUBY VEHICLE REPORT, AS THE CASE MAY BE, WHETHER FOR BREACH OF CONTRACT, TORTIOUS BEHAVIOR (INCLUDING STRICT LIABILITY), NEGLIGENCE, OR UNDER ANY OTHER CAUSE OF ACTION.
   YOU SPECIFICALLY ACKNOWLEDGE THAT LOOKSEEBUY IS NOT LIABLE FOR THE DEFAMATORY, OFFENSIVE, OR ILLEGAL CONDUCT OF OTHER USERS OR THIRD-PARTIES THROUGH THE USE OF THE LOOKSEEBUY WEBSITE, LOOKSEEBUY APP OR LOOKSEEBUY VEHICLE INSPECTION REPORT AND THAT THE RISK OF INJURY FROM THE FOREGOING RESTS ENTIRELY WITH YOU.
   IN NO EVENT SHALL LOOKSEEBUY, OR ANY PERSON OR ENTITY INVOLVED IN CREATING, PRODUCING, OR DISTRIBUTING THE WEBSITE, THE APP, OR THE CONTENT INCLUDED THEREIN, OR ANY LOOKSEEBUY VEHICLE REPORT, BE LIABLE IN CONTRACT, IN TORT (INCLUDING FOR ITS OWN NEGLIGENCE) OR UNDER ANY OTHER LEGAL THEORY (INCLUDING STRICT LIABILITY) FOR ANY DAMAGES, INCLUDING, WITHOUT LIMITATION, DIRECT, INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE, CONSEQUENTIAL, OR SIMILAR DAMAGES, LOST PROFITS OR REVENUES, LOSS AND CONDITIONS, OR SIMILAR ECONOMIC LOSS, ARISING OUT OF THE USE OF OR INABILITY TO USE THE SITE OR THE CONTENT OF A LOOKSEEBUY VEHICLE REPORT. YOU HEREBY ACKNOWLEDGE THAT THE PROVISIONS OF THIS SECTION SHALL APPLY TO ALL USE OF AND CONTENT ON THE SITE, THE APP, OR IN ANY LOOKSEEBUY VEHICLE REPORT.
   IN NO EVENT SHALL LOOKSEEBUY’S TOTAL LIABILITY TO YOU FOR ALL DAMAGES, LOSSES, AND CAUSES OF ACTION (“CLAIM”) WHETHER IN CONTRACT, TORT (INCLUDING ITS OWN NEGLIGENCE) OR UNDER ANY OTHER LEGAL THEORY (INCLUDING STRICT LIABILITY) EXCEED THE AMOUNT PAID BY YOU, IF ANY, FOR ACCESSING THE SITE, THE APP OR OBTAINING ANY LOOKSEEBUY VEHICLE REPORT(S) OR OTHER INFORMATION FROM THE SITE, APP, OR VEHICLE REPORT DURING THE THIRTY (30) DAYS PRIOR TO THE EVENT GIVING RISE TO THE CLAIM.
   APPLICABLE LAW MAY NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU.
7. Cancellation ALL SALES ARE FINAL ONCE AN ORDER IS PLACED WITH LOOKSEEBUY. LookSeeBuy, at its sole discretion, may decline to undertake the requested inspection, in which case your prepaid inspection fee will be refunded. However, you cannot cancel your order for a refund.
8. Force majeure You agree that if LookSeeBuy is prevented from the performance of the inspection or report due to circumstances or causes beyond its control, such as restrictive laws or regulations, labor disputes, government regulations, acts, or actions, pandemics, endemics, or acts of God, then LookSeeBuy is excused from further obligations to you. LookSeeBuy, in its sole discretion, may cancel such an inspection.
9. Refund Policy after Inspection Report If you believe there are inaccuracies in the inspection report, you must submit them to us at Customer Service at LookSeeBuy.com within seven (7) days for consideration of a refund, which will be at the sole descrition of LookSeeBuy, and include specific details addressing the issue(s). Due to the complex mechanical nature of automobiles and factors that may affect their continued performance, all submissions must be received by LookSeeBuy within seven (7) days of the report being delivered to you.
10. Taxes The listed inspection price on our website does not include sales, use, excise or any other applicable taxes. Such taxes, if any apply, will be added to the cost of our service.
11. Contact All customer service communications to LookSeeBuy must be addressed at Customer Service at LookSeeBuy.com.
12. Privacy LookSeeBuy’s collection and use of any information is described in and governed by the Privacy Policy at LookSeeBuy.com unless otherwise stated. When you order a vehicle inspection with LookSeeBuy, you will be providing certain personal information to us. LookSeeBuy will only share your information with our affiliates to carry out the intent of the service you purchased from us or to present you special offers or incentives from our affiliates. We will not share your information with an unaffiliated third party, unless we are required to do so by law.
13. Communications with Inspectors You agree to communicate only with LookSeeBuy about your inspection and to not contact any inspector directly. Any attempt by you to contact an attempt to contact an inspector without LookSeeBuy’s consent, or attempt to remove LookSeeBuy from the inspection process, will be considered a breach of this agreement. Upon which, LookSeebuy has the right to cancel the inspection and will not refund any payment to you. You agree not to provide any compensation, monetary or otherwise, directly to Inspector.
14. Specific State Laws Some states do not allow the limitation, exclusion or disclaimer of implied warranties or incidental and consequential damages, so the limitations or disclaimers in this agreement may not apply to you.
15. Severability If any section of this agreement is found by competent authority to be invalid, illegal or unenforceable in any respect and for any reason, the validity, legality and enforceability of the unaffected remainder of such section and the remainder of the agreement will continue in effect.
